San Francisco Employment Discrimination Law Firm

California Discrimination Lawyers

Discrimination is a degrading experience. When it occurs in an employment setting, there are remedies under both California and federal law.

I'm San Francisco employment law attorney Stephen M. Murphy. I represent people who have experienced discrimination at work. My clients come to me to try to right that wrong.

What Is Employee Discrimination?

Employment discrimination can take many forms. It may be failure to hire or promote based on a person's protected status such as age, gender, race, disability, sexual orientation, national origin, religion or pregnancy. It may also involve disciplining, terminating or denying employment benefits due to a person's status or judging his or her performance according to a higher standard.

What Should I Do if I Experience Employment Discrimination?

Employment discrimination can be hard to prove. Most companies know that they can't hire or fire based on age, race or other status, so they are careful in the words they use. To prove discrimination, your lawyer has to show that your employer intentionally deprived you of a job benefit because of your protected status. To do this, your lawyer must prove that the employer's reason for its action is untrue or pretextual.

If you report incidents of employment discrimination to the company's human resources department, the conduct may stop. In that case, you would not need a lawyer. If the conduct doesn't stop, you will make your case stronger by reporting it. Our lawyers offer a free initial consultation to discuss your case and explain your options.

Compensation for victims of employment discrimination: Our attorneys obtained a $312,000 settlement for a 45-year-old woman who was denied a promotion that went to a less-experienced, 28-year-old woman.
